Kearney loses by directed verdict 7/6/2015 and the Abruzzo's turn around and sue Kearney for breach of his trust duties as a trustee and is otherwise incapable of performing the duties of trustee and should be removed.
The request of the Abruzzo's is to modification or the termination of the MPK trust. The use of the words termination and modification is the key to the Abruzzo's scheme to alter or take the trust left by Marypat for Kearney's benefit for life.
When reading James Beckley letter dated January 2005 termination was never really what the Abruzzo's wanted because of the Sub-S conversion they asked Kearney to sign in 2005.

The letter clearly states that if MPK trust is terminated during income beneficiary the entire Principal and income must be distributed to current beneficiary. This is a tactic used by the Abruzzo's to obtain all of Kearney's financial information both personal and business including tax returns.
The reason this is because of termination or modification to MPK trust requires that all of Kearney and trust assets are valued to reach fair adjustment to the remaindermen trust and Kearney.
